1. Agreement to Terms
These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and JunkOut Irvine (“Company,” “we,” “us,” or “our”), a California-based junk removal service provider.
By accessing our website at junkoutirvine.com, requesting a quote, booking our services, or allowing our crew onto your property, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
These Terms apply to all junk removal services, including residential cleanouts, commercial hauling, estate cleanouts, construction debris removal, and any other services provided by JunkOut Irvine in Orange County, California.
2. Description of Services
JunkOut Irvine provides full-service junk removal, hauling, and disposal services. Our standard service includes:
- Arrival at your location within the scheduled two-hour window
- Assessment of items to be removed and final price confirmation
- Loading of approved items onto our truck by our trained crew
- Cleanup of the immediate work area (sweeping, debris removal)
- Transportation and proper disposal, recycling, or donation of items
2.1 Service Exclusions
Unless specifically agreed in writing, our services do NOT include:
- Demolition or structural modification of buildings
- Hazardous waste removal (see Section 6)
- Deep cleaning, carpet cleaning, or restoration services
- Moving services for items being kept by the customer
- Storage of items at our facility
2.2 Service Modifications
We reserve the right to modify services based on site conditions, safety concerns, or the discovery of prohibited items. Any modifications that affect pricing will be discussed with you before work proceeds.
3. Service Area & Scheduling
3.1 Service Area
We primarily serve Irvine, California and surrounding Orange County cities including Tustin, Lake Forest, Newport Beach, Costa Mesa, Santa Ana, and Orange. Service outside our standard area may incur additional travel fees, which will be disclosed before booking.
3.2 Scheduling
- Standard Appointments: Scheduled in two-hour arrival windows (e.g., 9:00 AM – 11:00 AM)
- Same-Day Service: Available on a first-come, first-served basis for calls received before 10:00 AM on weekdays, subject to crew availability
- Weekend Service: Saturday appointments available; Sunday reserved for emergency calls only
3.3 Arrival Time
We will call or text 15 minutes before arrival. While we make every effort to arrive within the scheduled window, traffic, weather, or previous job complications may cause delays. We will communicate any delays as soon as possible.
4. Pricing & Payment
4.1 Pricing Structure
Our pricing is based on volume and item type:
- Single Item: $69 – $120
- ¼ Truck Load: $149 – $249
- ½ Truck Load: $219 – $399
- Full Truck Load: $399 – $750
Additional fees may apply for: heavy items requiring extra labor (pianos, safes, hot tubs), refrigerant recovery (appliances), long carry distances (over 50 feet from truck), stairs (3rd floor and above), and specialized disposal requirements.
4.2 Price Quotes
Phone and online quotes are estimates based on customer descriptions or photos. Final pricing is determined on-site after our crew assesses the actual volume, weight, and access conditions. You will receive a firm, no-obligation price before any work begins.
Important: Once you approve the on-site price and we begin loading, the price is locked. We do not add surprise fees after loading begins.
4.3 Payment Methods
We accept the following payment methods:
- Cash
- Credit/Debit Cards (Visa, MasterCard, American Express, Discover)
- Check (for commercial accounts with prior approval)
4.4 Payment Timing
Payment is due in full upon completion of services, before our crew leaves your property. For commercial accounts with established credit terms, payment is due within 15 days of invoice date.
4.5 Refunds
Refunds are issued only in accordance with our Satisfaction Guarantee (Section 11). No refunds are provided for services already rendered unless the work fails to meet our quality standards.
5. Cancellation & Rescheduling
5.1 Cancellation by Customer
- More than 24 hours notice: Full refund of any deposit, no cancellation fee
- 12-24 hours notice: $50 cancellation fee
- Less than 12 hours notice: $75 cancellation fee
- No-show or refusal of service upon arrival: $100 trip charge
5.2 Rescheduling
You may reschedule your appointment at no charge if you provide at least 12 hours notice. Rescheduling requests with less than 12 hours notice may be treated as cancellations subject to the fees above.
5.3 Cancellation by JunkOut Irvine
We reserve the right to cancel or reschedule appointments due to unsafe weather conditions, equipment failure, crew illness, or other unforeseen circumstances. If we cancel, you will receive a full refund of any deposits and priority rescheduling at no additional cost.
6. What We Remove / Prohibited Items
6.1 Items We Accept
We remove most household and commercial items including:
- Furniture (couches, chairs, tables, mattresses, dressers)
- Appliances (refrigerators, washers, dryers, stoves, water heaters)
- Electronics (TVs, computers, printers, stereos)
- Yard waste (branches, leaves, dirt, sod)
- Construction debris (drywall, lumber, tile, concrete – limited quantities)
- General household junk and clutter
- Office furniture and equipment
6.2 Prohibited Items
We CANNOT remove the following items:
- Hazardous Materials: Paint, paint thinner, stains, solvents, chemicals, pesticides, herbicides, motor oil, antifreeze, gasoline, propane tanks, asbestos-containing materials
- Biohazards: Medical waste, syringes, items contaminated with blood or bodily fluids, animal waste
- Explosives & Ammunition: Fireworks, ammunition, gunpowder, flares
- Pressurized Containers: Full propane tanks, oxygen tanks, fire extinguishers (unless certified empty)
- Illegal Items: Drugs, drug paraphernalia, stolen property
- Extreme Heavy Items: Items over 400 lbs without prior arrangement (some safes, industrial equipment)
6.3 Consequences of Prohibited Items
If we discover prohibited items after loading has begun, we will stop work immediately and discuss options with you. Disposal of hazardous materials discovered in our truck may result in additional fees of $150–$500 plus actual disposal costs. We reserve the right to refuse service and charge a trip fee if prohibited items are knowingly concealed.
7. Property Access & Safety
7.1 Access Requirements
You must provide safe, legal access to the items being removed. This includes:
- Clear pathways free of ice, snow, or tripping hazards
- Working elevators or stair access for multi-level properties
- Parking space for our truck within 50 feet of the loading area
- Proper authorization to remove items (you must own the property or have written permission from the owner)
7.2 HOA and Building Requirements
Customers are responsible for obtaining any necessary HOA approvals, building management permissions, or parking permits required for our work. We are not responsible for HOA fines or building violations resulting from unauthorized service.
7.3 Safety Limitations
Our crew will not work in conditions they deem unsafe, including but not limited to: active construction zones without hard hats, areas with exposed electrical wiring, attics with inadequate flooring, or spaces with dangerous animals. If we cannot safely access items, we may need to reschedule or modify the service scope.
8. Recycling & Disposal
JunkOut Irvine is committed to environmentally responsible disposal. We sort all loads to maximize donation and recycling:
- Donation: Usable furniture, appliances, and household items go to Goodwill, Habitat for Humanity ReStore, or local charities
- Recycling: Metal, electronics, mattresses, and cardboard are routed to certified recycling facilities
- Landfill: Only non-recyclable, non-donatable materials go to Orange County transfer stations
While we strive to divert 50-60% of materials from landfills, we cannot guarantee specific diversion rates for every load. We do not provide donation receipts; customers seeking tax deductions should arrange their own donations before our arrival.
9. Liability & Insurance
9.1 Our Insurance Coverage
JunkOut Irvine carries the following insurance coverage:
- General Liability Insurance: $2,000,000 per occurrence
- Auto Liability Insurance: $1,000,000 per occurrence
- Workers’ Compensation: As required by California law
Certificates of Insurance available upon request for commercial clients and property managers.
9.2 Damage to Property
We exercise extreme care when removing items from your property. However, minor cosmetic damage (scuffs, small scratches) may occur during heavy item removal, particularly in tight spaces or with older homes. We are not liable for:
- Pre-existing damage to walls, floors, or doorways
- Damage caused by inadequate access or pathways provided by the customer
- Damage to items not being removed that are left in the work area
- Damage resulting from structural weaknesses in your property (rotten floorboards, unstable stairs)
Any damage caused by our negligence will be repaired at our expense or compensated up to the limits of our insurance policy.
10. Customer Responsibilities
By booking our services, you agree to:
- Ownership: Confirm that you own all items being removed or have written authorization from the property owner
- Accuracy: Provide accurate descriptions of items and access conditions when requesting quotes
- Preparation: Clear pathways and ensure safe working conditions before our arrival
- Presence: Be present at the start of the job to confirm what goes, or provide detailed written instructions and contact information
- Payment: Provide valid payment upon completion of services
- Pets: Secure pets in a separate area during service
- Valuables: Remove cash, jewelry, and small valuables from the work area before our arrival
11. Satisfaction Guarantee
Our Promise: If you’re not completely satisfied with our service, we’ll make it right or refund your money.
Our satisfaction guarantee covers:
- Incomplete removal of agreed-upon items
- Damage caused by our crew (beyond the limitations in Section 9)
- Unprofessional conduct by our team
To make a claim under our guarantee, you must contact us within 24 hours of service completion at junkoutirvine@gmail.com or (949) 556-3600. We will either return to complete the work at no charge or issue a partial or full refund based on the circumstances.
The guarantee does not cover:
- Changes of mind after work is completed
- Additional items added after the agreed scope
- Issues arising from customer-provided inaccurate information
12. Intellectual Property
All content on junkoutirvine.com, including text, images, logos, and design elements, is the property of JunkOut Irvine and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works from our content without written permission.
By using our services, you grant us permission to photograph completed work for marketing purposes (website, social media, advertising), provided we do not identify you personally without your separate written consent.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW:
- Our total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim
- We are not liable for any indirect, incidental, special, consequential, or punitive damages
- We are not liable for delays caused by factors beyond our reasonable control (traffic, weather, facility closures)
- We are not liable for the value of items removed (sentimental or monetary) once they have been hauled away
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless JunkOut Irvine, its owners, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from:
- Your violation of these Terms
- Your misuse of our services
- Any injury or damage caused by items you instructed us to remove
- Any breach of your representations or warranties under these Terms
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these Terms or our services shall be brought exclusively in the state or federal courts located in Orange County, California.
16. Changes to Terms
We may update these Terms from time to time. The “Last Updated” date at the top of this page indicates when revisions were last made. Material changes will be posted on our website with 30 days notice when possible. Your continued use of our services after changes take effect constitutes acceptance of the revised Terms.
